The petitioner is in custody in a case registered under Sections 20/22 of the N.D.P.S. Act.
The prosecution case, in brief, is that the informant A.S.I. Kumar Pramod recorded his self-statement on 2.1.2015 alleging therein that in course of motorcycle checking, he got information near Salai Factory that a person is going to Rambhadrapur Station on foot with a bag having narcotic substance and thereafter the informant caught him near Durga Mandir who was trying to flee away seeing the police. It is further alleged that he disclosed his name as Ram Sogarath Ram and further from his bag 1 kg. 600 grams Ganja was alleged to
Patna High Court Cr.Misc. No.22053 of 2015 (2) dt.14-07-2015 2/2 have been recovered and accordingly seizure was effected in presence of independent witnesses and the present case was registered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.1.2015 and charge sheet has been submitted in the case. It is further submitted that from the possession of the petitioner one Kg. stick of Ganja and 600 Grams powdered Ganja are said to have been recovered. It has further been submitted that the same is much below the commercial quantity.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Samastipur, in connection with Warisnagar P.S. Case No.03/2015 (N.D.P.S. Case No.01/2015).
