JUSTICE RAJESH KUMAR VERMA ORAL ORDER 20-09-2024 Heard Mr. Shivnandan Bharti, the learned counsel for the petitioner and Mr. Ram Anurag Singh, the learned Additional Public Prosecutor for the State.
2. Petitioner seeks regular bail who is in custody since 31.03.2023, in connection with Danapur P.S. Case No. 206 of 2023, FIR dated 14.02.2023, registered for the offences punishable under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.
3. As per FIR, the police got information that some people were cheating innocent persons in the name of providing job in the military.
4. Earlier prayer for bail of the petitioner was rejected vide order dated 23.08.2023 passed in Cr. Misc. No.
2/4 47610 of 2023.
5. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in connection with the present case on the basis of suspicion. It is further submitted that name of the petitioner has surfaced during investigation on the basis of the confessional statement of co-accused persons. It is further submitted that similarly situated co-accused person, namely, Ranjan Kumar @ Guddu has been granted bail vide order dated 19.07.2023 passed in Cr. Misc. No. 37773 of 2023 and co-accused namely, Shammi Raj @ Anil Kumar & Satish Kumar @ Sanni have also been granted bail vide order dated 14.07.2023 passed in Cr. Misc. No. 38113 of 2023 by a co-ordinate Bench of this Hon'ble Court. It is further submitted police after investigation submitted charge sheet against the petitioner and the petitioner is in custody since 31.03.2023.

The learned Additional Public Prosecutor for the State on the other hand has vehemently opposed the prayer for bail of the petitioner and submits that articles as mentioned in the seizure list have been recovered from the room of the petitioner which suggests that the petitioner involved in the present crime aforesaid.

Considering the aforesaid facts that the petitioner has no criminal antecedent and similarly situated other co-accused persons have been granted bail by a coordinate Bench of this Hon'ble Court, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Class, Danapur, Patna in connection with Danapur P.S. Case No. 206 of 2023, subject to the following conditions:
(i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the learned trial Court and shall remain physically present as directed by the learned trial Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the learned trial Court.
(ii) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
(iii) And further condition that the learned trial Court shall verify the criminal antecedent of the petitioner and in case, at any stage, it is found that the petitioner has concealed his
4/4 criminal antecedent, the learned trial Court shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
