JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Mahila P.S.Case No. 62 of 2020 for the offences punishable under Sections 498A, 494 and 506 of the Indian Penal Code.
It is a case of cruelty and torture for non fulfillment of dowry demand.
Learned counsel for the petitioner submitted that petitioner has falsely been implicated in the present case. Further submitted that complainant namely, Puja Kumari Yadav was not the wife of the petitioner and as such no offence is made
Patna High Court CR. MISC. No.4761 of 2021(7) dt.28-02-2022 2/2 out under section 498A of the Indian Penal Code. Opposite party no. 2 suppressed this fact that her brother was married to sister of the petitioner.
Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st class, Patna in connection with Mahila P.S.Case No. 62 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
