JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25 (1-B)A/25(1-A)A/25(1-c) A/26(i) (ii) (iii)/35 of Arms Act.

On raid, mini gun factory was unearthed from the house of the petitioner in the year 2006 but admittedly the petitioner was neither arrested on the spot nor the aforesaid search was made in his presence. Moreover, the petitioner was arrested subsequently and remanded to judicial custody on 29.07.2015. The petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.20062 of 2016 (3) dt.18-05-2016 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Munger in connection with Sessions Trial No. 390 of 2011, arising out of Asarganj P.S. Case No. 18 of 2006, subject to condition that one of the sureties must be close relative of the petitioner, who shall swear affidavit to this effect as to how is he related with the petitioner.
