The petitioner seeks pre-arrest bail in connection with Dinara P.S.Case No.252 of 2017 registered under Sections 341, 323, 332, 354, 353, 504 and 506/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that as per the version of the informant in her statement, there is nothing even to remotely suggest that ingredients of Section 354B of the I.P.C. are satisfied so as to attract the said provision against the petitioner. He submitted that even ingredients of Sections 332 and 353 of the Indian Penal Code are not attracted in the present case because by wandering in the school campus, the informant was not performing any duty and as such basic ingredients of the
Patna High Court Cr.Misc. No.60648 of 2017 (2) dt.21-12-2017 2/2 said Sections are not attracted in the present case. Learned counsel for the State opposed the prayer for grant of pre-arrest bail to the petitioner.
Considering the nature of allegation and the submissions made on behalf of the parties, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rohtas, Sasaram in connection with Dinara P.S. Case No.252 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
