The petitioner is in custody in a case registered under Sections 420/34 of the Indian Penal Code.

It is alleged by the informant that the villagers of village Muschak submitted a complaint petition alleging that the petitioner; contractor under Rajeev Gandhi Electrification Scheme, in collusion with Mahtab Alam, the site Engineer Shyam Power Indian Limited has collected Rs. 40,000/- illegally in collusion with each other. It is further alleged that after receiving the complaint from villagers the informant went to the village where the villagers told that Rs. 200/- to 500/- was collected from B.P.L. holders for electric connection.

No.21156 of 2015 (2) dt.14-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has been made accused in the present case due to mistake of fact. It is further submitted that the petitioner is in custody since 23.3.2015 and the charge sheet has been submitted in this case. Further it has been submitted that the petitioner is ready to deposit an amount of Rs. 20,000/- in the court below, which shall be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, the above named petitioner is directed to deposit an amount of Rs. 20,000/- in the court below, which shall be subject to final disposal of the case, and on doing so, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deo Priya Kumar, Judicial Magistrate, 1st Class, Begusarai, in Sahebpur Kamal P.S.Case No. 197 of 2014.
