The petitioners apprehend their arrest in Deepnagar P.S. case No. 67 of 2019 registered under Section 323, 341, 307, 504, 506/34 of the IPC.
The informant named the three petitioners along with Rahul Yadav and alleged that all the accused persons began to abuse and assaulted his brother, Ashok Yadav. Krishna Yadav, petitioner No.1, is alleged to have assaulted the brother of informant with spade on his head and other accused persons indiscriminately assaulted till his brother became unconscious. The learned counsel for the petitioners submits that the occurrence took place due to irrigation of land and all the

No.45669 of 2019(3) dt.30-09-2019 2/2 injuries found on the person of brother of informant are simple in nature but it appears from perusal of injury report that extensive injury on scalp, swelling above left side of scapular region, abrasion all over upper back, dark black coloured skin all over upper back and swelling on left forearm of brother of informant was found. The injury report shows that brother of the informant was thrashed with stick.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
