The petitioner seeks bail in a case registered under Sections 302, 394 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that two miscreants on a motorcycle came at the shop of the informant and on the point of gun looted away galla (cash box) and opened fire upon informant's staff, namely, Pankaj Kumar. He was taken to the Hospital, but on the way he died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.02.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.45466 of 2019(2) dt.23-07-2019 2/2 named in the F.I.R. His name has come on confessional statement of co-accused. No looted article is alleged to have been recovered from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. case No.312 of 2018.
