The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The informant is the father of the deceased, Triloki Mahto. The first information report is against unknown. During course of the investigation, the informant in his further statement disclosed that his son had gone to see Ranjeet Mahto @ Chaudhra, the petitioner in the preceding night but he did not return. The mother of the deceased also made similar statement. Upendra Kumar Mahto and Pravesh Kumar Mahto have disclosed in para-9 and 10 that Ranjeet Mahto, Birju Ram and Sanu Singh came at the place where dead body was recovered but when the police was

Patna High Court Cr.Misc. No.20255 of 2015 (3) dt.24-08-2015 2/2 informed they fled away. On the neck of Ranjeet Mahto blood stained was found but there is no eye witness of the occurrence nor any blood stained cloth was recovered from possession of Ranjeet Mahto.

Considering the fact that except suspicion, there appears no tangible material, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra in Chapra (M) P.S. Case No. 187 of 2014.
