JUSTICE SHIVAJI PANDEY ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In this case the petitioner is seeking bail in connection with Chanpatia P.S. Case No.45/15 registered for the offences under Sections341, 323, 324, 307, 379 & 34 of the I.P.C. There is accusation against the petitioner along with other co-accused of abusing in drunken state and on being forbidden they armed with lathi and rod and the petitioner gave rod blow to the father of the informant who sustained injury and fell down. The accused persons also assaulted the informant, his brother and mother causing injuries to them.

Counsel for the petitioner submits that the petitioner had moved this Court in Cr.Misc.No.51008/15. This Court had rejected the prayer for bail of the petitioner vide order dated

Patna High Court Cr.Misc. No.12046 of 2016 (2) dt.30-03-2016 2/2 10.11.2015 with liberty to the petitioner to renew his prayer for bail after completion of seven months in custody. Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., West Champaran at Bettiah, in Chanpatia P.S.Case No.45/15.
