====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-06-2021 Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 376 of I.P.C., Section 4 POCSO Act and 3/4 of D.P.Act.

The informant, who was a major, on the date of FIR, was with consent in physical relation with the petitioner. When the villagers protested against physical relation before marriage, the petitioner was sent to jail. The petitioner promised to marry within ten days of his release, however, he did not marry and there was demand of dowry. Evidently, there is no material that the petitioner was of dishonest and fraudulent intention at the beginning of relationship. Investigation of the case is already complete.

Hence, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.5464 of 2021(4) dt.28-06-2021 2/2 bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanhauli Police Station Case No.81 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
