JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and State. The petitioner is apprehending his arrest in connection with Ishaqchak P.S. case no. 111 of 2017 for the offence under Sections 341, 323, 384, 386, 506/34 of the Indian Penal Code.

Counsel for the petitioner submits that in fact the instant case was lodged on account of altercation took place between the petitioner and the informant's side when the motorcycle allegedly driven by the petitioner's side collided and caused injury to the informant's side. According to the counsel for the petitioner that from the F.I.R. there is no specific allegation against this petitioner of any act of omission or commission for constituting any offence either for assault or snatching money from the purse or demanding ransom.

No.53622 of 2017 (2) dt.09-11-2017 2/2 Considering the fact that there is no specific allegation against this petitioner, the petitioner, named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Additional Chief Judicial Magistrate-VI/incharge, Bhagalpur in connection with Ishaqchak P.S. case no. 111 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
