====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 01-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Parbatta P.S. Case No. 87 of 2024 dated 29.02.2024 registered for the offences punishable under Sections 341, 342, 323, 504, 506 and 379/34 of the I.P.C.

3. As per the prosecution case, on 27.02.2024, while the informant was sleeping in his Basa, the co-accused Munna Chaudhary, Arvind Chaudhary alongwith 4-5 unknown miscreants came and surrounded him by showing a pistol and took away his Tractor bearing Registration No. BR34GA0783.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner is not named in the F.I.R. His name has sprung up in the present case on the basis of the confessional statement of the co-accused Ranvir Yadav who has stated that he alongwith the co-accused Kunal Yadav had brought the tractor without number plate and kept it to the basa of the petitioner and the said Ranvir Yadav @ Ranbir Yadav @ Lalu Yadav has already been granted bail by a Bench of this Court vide Cr. Misc. No. 42375 of 2024 under order dated 24.06.2024. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 16.03.2024.

5.Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Khagaria in connection with Parbatta P.S.
