The petitioner is languishing in custody since 05.12.2014 in a case registered for the offences punishable under Sections 363 and 364/34 of the Indian Penal Code. It is alleged that when the informant's four years son went missing then the FIR was lodged suspecting the hands of the petitioner due to old enmity.
It is submitted by learned counsel for the petitioner that in 2-3 hours of the occurrence the victim was recovered from the possession of Bharat, Dharmendra and Vina Devi. Statement to that effect has been made in para 10 of the petition. Statement has been made in para 9 of the petition that
Patna High Court Cr.Misc. No.22322 of 2015 (2) dt.09-07-2015 2/2 petitioner is on litigating term with the informant from before. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and the investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 475 of 2014.
