Petitioner in the present case is seeking anticipatory bail in connection with Nawkothi P.S. Case No. 24 of 2019 registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

It is alleged in the first information report that the daughter of this informant who was aged about 14 years had gone to the village market with the co-villagers namely Kaili Devi, Sulena Kumari and Anita Devi (Petitioner) but she did not come back. It is alleged that the daughter of the informant has been kidnapped.

Learned A.P.P. for the State has after going through

Patna High Court CR. MISC. No.47057 of 2019(3) dt.14-10-2019 2/2 the materials collected in the case diary submits that the name of this petitioner has also transpired in Paragraph '5', '6' and '7' of the case diary and the victim girl has yet not returned. Considering the facts and circumstances of this case wherein the name of this petitioner has transpired with whom the victim girl had gone to the village market but did not return and till date the girl is not traceable, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The application is, thus, dismissed.

In case, the petitioner surrenders in the court below and prays for regular bail within a period of four weeks from today, the same shall be considered on its own merit without being prejudiced of the order of this Court.
