Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Parbatta P.S. Case No. 174 of 2022, lodged under Sections 25(1b)26 of the Arms Act. As per prosecution case, the Police has received information that a person is sitting in tea shop with arms having no license, upon raid, Police has snatched the said person, from whose possession one pistol and live cartridges were recovered and the said person was apprehended.

Learned counsel for the petitioner submits that the age of petitioner is about 63 years. He further submits that under a

Patna High Court CR. MISC. No.48052 of 2022(2) dt.23-12-2022 2/2 deep rooted conspiracy arms have been recovered from the possession of petitioner. He also submits that petitioner is in custody since 30.04.2022 having clean antecedent. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 174 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
