====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-12-2023 Heard the learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner apprehends his arrest in connection with Mairwa P.S. Case No. 115 of 2022, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

3. As per allegation, 7 quintals of electric wire were recovered from a vehicle and the arrested driver disclosed that coaccused Rahul Singh @ Bhola Singh had fled away, after leaving that vehicle.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The main allegation is against co-accused Rahul Singh @

Patna High Court CR. MISC. No.57426 of 2023(3) dt.06-12-2023 2/2 Bhola Singh. The petitioner has falsely been implicated merely because the vehicle is registered in his name.

5. On the other hand, the learned counsel for the Electricity Department has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIIth, Siwan in connection with Mairwa P.S. Case No. 115 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.

7. Further condition is that after accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner.
