JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 302 and other allied Sections of the Indian Penal Code as well as Section 27 of the Arms Act.

Petitioner is named in the first information report, but according to the prosecution case itself, it were co-accused Dhiraj Kumar and Rajesh Mahto, who shot fire on the deceased and so far as petitioner is concerned, it is alleged that he along with coaccused Anita Devi and Juli Kumari instigated the other accused to open fire.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten

Patna High Court Cr.Misc. No.12372 of 2016 (2) dt.18-03-2016 2/2 thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Munger in connection with Muffasil P.S. Case No.230 of 2015.
