JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-12-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Chainpur P. S. Case No. 110 of 2017, G. R. No. 1060 of 2017 registered under Sections 147, 149, 341, 323, 379, 353, 332, 333 and 504 of the Indian Penal Code and 33 and 41 of the Indian Forest Act.

It is submitted by the learned counsel for the petitioners that co-accused Putun Rai and Pratap Pandey having identical allegation to that of the petitioners have already been granted pre-arrest bail vide order dated 19.09.2017 passed in Cr.

Patna High Court Cr.Misc. No.55214 of 2017 (2) dt.19-12-2017 2/2 Misc. No. 45131 of 2017 by a co-ordinate Bench of this Court. Learned Additional Public Prosecutor for the State does not dispute the aforesaid submission made by the learned counsel for the petitioners.

Regard being had to the nature of allegation and the submission made above, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-II, Kaimur at Bhabhua in Chainpur P. S. Case No. 110 of 2017, G. R. No. 1060 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
