2. The petitioner has preferred this application for grant of regular bail in connection with Warisaliganj P.S. Case No. 173 of 2024 dated 07.05.2024 registered for the offences punishable u/ss 419, 420, 467, 468, 471 read with Section 34 of the Indian Penal Code and u/ss 66B and 66D of the I.T. Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have engaged in Cyber Crime and disclosed that they would give advertisement over facebook regarding loan from Dhani Finance from fake I.D.
Patna High Court CR. MISC. No.52177 of 2024(4) dt.25-10-2024 2/3 and mobile number and used to cheat people. It is further alleged that mobile phones, five ATM cards, Aadhar card and PAN card, owner book of motorcycle, voter card and three photographs were recovered from the possession of the accused persons.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has surfaced in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has no concern with the alleged offence. The co-accused person has already been granted regular bail by this court vide order dated 29.08.2024 passed in Cr. Misc. No. 55660 of 2024. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.05.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the two mobile phones and Rs. 35,000/- were recovered from the possession of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner
Patna High Court CR. MISC. No.52177 of 2024(4) dt.25-10-2024 3/3 above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Warsaliganj P.S. Case No. 173 of 2024.
7. The application stands allowed.
