The petitioner is in judicial custody in connection with Madhubani Town P.S. Case No. 304 of 2020 under sections 366 and 367 of the Indian Penal Code.

As per the FIR, the informant alleged that his married daughter had gone to 'Durga Mandir' for prayer where six accused persons came on a four wheeler and abducted her with an intention to kill or sell. The said occurrence was seen by several persons.

The petitioner was the person who took the lady with him as is reflected from the order of the learned Sessions Judge wherein it has been described that as per the statement under 164 of the Cr.P.C. the victim has recorded that she had not gone

Patna High Court CR. MISC. No.58668 of 2021(2) dt.12-04-2022 2/2 with the petitioner willingly rather was induced by him. The petitioner was arrested from Delhi Mod, Darbhanga Bus Stand from where the victim lady was also recovered. In view of the aforesaid facts and circumstances, this Court is not inclined to grant any relief to the petitioner which is accordingly rejected.
