JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 2 namely Sadan Kumar has been arrested and as such, he seeks permission to withdraw this petition, so far as petitioner no. 2 is concerned. Accordingly, in respect of petitioner no. 2, this petition is dismissed as withdrawn.
Sole petitioner (i.e. petitioner no. 1) apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per F.I.R., this petitioner alongwith other F.I.R. named co-accused persons are alleged to have assaulted informant and her husband with iron rod and a sharp weapon.
Patna High Court CR. MISC. No.48332 of 2022(2) dt.13-12-2022 2/2 It is submitted on behalf of petitioner that specific accusation of assault is against co-accused Sadan Kumar. So far as this petitioner is concerned, there is general and omnibus allegation. Injury is simple in nature.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the nature of accusation and injury, in the event of arrest/surrender within a period of six weeks from today, let the petitioner namely Ambika Sah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Begusarai Town P.S. Case No. 713 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. This application is, accordingly, disposed of. (Prabhat Kumar Singh, J) anay/- U T
