2. The petitioner seeks bail in a case registered for the offence punishable under Sections-304(B), 34 of the Indian Penal Code.

3. Allegation against the accused persons including the petitioner is of torturing and causing death of the victim due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Eight prosecution witnesses including the informant have been examined and none has supported the prosecution case. The informant, in his deposition, has stated that the

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 438 of 2022 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court. 7.The petitioner will appear in the court below on each and every date fixed in the case.
