Heard the learned counsel for the petitioner as well as Mr. J. N. Thakur, the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 63 of 2020 registered for offence punishable under section 414/34 of the Indian Penal Code. As per allegation, the police got an information that FIR named accused persons were indulged in transaction of stolen two wheeler. The houses of the accused persons were searched. The allegation against the present petitioner is that one motor cycle was found parked at the river bank near the hut of the petitioner.

No.58176 of 2021(2) dt.08-07-2022 2/2 The learned counsel for the petitioner has submitted that the alleged motor cycle was not recovered from the house of the petitioner, it was recovered from the river bank. The petitioner has no concern with that motor cycle and he is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, specially the fact that the petitioner is a person of clean antecedent, let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Hajipur, Vaishali in connection with Raghopur P.S. Case No. 63 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
