JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-03-2021 Heard Mr. Rajeeet Kumar Mishra, learned Counsel for the petitioner and Mr. Upendra Kumar, learned Additional Public Prosecutor for the State, through Video Conferencing. This application, for grant of regular bail, arises out of Pupri Police Station Case No. 364 of 2018 (Sessions Trial No. 43 of 2020), disclosing offences under Section 304(B)/34 of the Indian Penal Code.

This is second attempt for regular bail on behalf of the petitioner inasmuch as the bail application of the petitioner was earlier rejected by a Coordinate Bench of this Court in Cr. Misc. No.85567 of 2019.

The allegation against the petitioner is that the

Patna High Court CR. MISC. No.4799 of 2021(2) dt.25-03-2021 2/3 petitioner along with others allegedly killed daughter of the informant, due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and he is in custody since 04.11.2019. Learned counsel next referring to Annexure-3 submits that the charges have been framed against the petitioner by the learned trial Court on 30.09.2020. Learned counsel next submits that earlier bail application of the petitioner was rejected with liberty to renew his prayer after framing of charge.

Having regard to the submissions made by the parties and taking into consideration the observation of the Coordinate Bench of this Court giving liberty to the petitioner to renew his prayer for bail after framing of charge and from Annexure-3, it appears that the charges have already been framed against the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, Md. Jainul Ansari @ Jainul Ansari, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Sitamarhi/ concerned Court, in connection with Pupri Police Station Case No. 364 of 2018 (Sessions Trial No. 43 of 2020).
