JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one co-accused, Ramjee Prasad were caught by the informant and other officials and 15.5 kg. charas were recovered from possession of co-accused, Ramjee Prasad. The contention on behalf of the petitioner is that petitioner was implicated in this case by the informant and as a matter of fact, petitioner is resident of village Hardia Chowk and he was standing on his door but he was caught by the informant on the basis of suspicion and moreover, the motorcycle, which had been used in this crime, was also not of the petitioner and he does not have any criminal antecedent.

Patna High Court Cr.Misc. No.5561 of 2015 (3) dt.27-04-2015 Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Narkatiyaganj G.R.P. P.S. Case No. 26 of 2014 corresponding to N.D.P.S. Case No. 15 of 2014 pending in the court of learned Sessions Judge, Bettiah, West Champaran stands rejected, at least, at this stage.
