ANSHUMAN ORAL ORDER 20-01-2023 Heard learned counsel for the petitioner, counsel for the Respondents and counsel for the F.C.I. through virtual The present writ application has been filed seeking the relief of granting family pension with effect from 03.11.2002 and other retrial dues, seeking on the ground that husband of the petitioner was working as Handling Labour in Digha Patna in Food Corporation of India and died on 02.11.2002. Counsel for the petitioner submits that he has filed representation in the year 2017 and 2018 and subsequently in the year 2021 but no action was taken.

Counsel for the F.C.I. has filed a counter affidavit in this case and categorically demanded documents mentioned in

Patna High Court CWJC No.17300 of 2021(2) dt.20-01-2023 2/2 paragraph - 8.

Counsel for the respondents submits that it is a matter of surprise that after death of 15 years, this claim has been demanded. But for the purpose of consideration of the claim, F.C.I. seeks certain documents, list of which are provided in paragraph - 8 of the counter affidavit.

Counsel for the petitioner submits that during pendency of the writ petition, he has provided all the documents.

If it is so, then F.C.I. is directed to take decision on the matter relating to the petitioner and if not, then also, F.C.I. is directed to intimate to the petitioner that what are the deficiencies in the documents and after production of all the documents, as required, the authority shall decide the claim of the petitioner within 6 weeks and pass a reasoned order. With this direction, this Writ petition is hereby disposed off.
