Petitioner was not caught on the spot and his name is said to have been disclosed by co-accused who was caught on the spot. Medical report of the victim does not disclose any sign of rape, although victim was medically examined on 16.8.2014 whereas occurrence is said to have taken place on 13.8.2014. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Raja Ram Santosh Kumar, Judicial Magistrate, Ist Class, Biroul at Benipur/concerned court in Ghanshyampur P.S. Case no. 149/2014.
