JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is not named in the first information report but from perusal of the impugned order I find that name of petitioner came in this case in confessional statement of coaccused, Rigan Manjhi. Contention on behalf of the petitioner is that aforesaid Rigan Manjhi has already been granted privilege of bail and except the above stated confessional statement of co-accused,
Patna High Court Cr.Misc. No.12582 of 2016 (2) dt.28-03-2016 2/2 Rigan Manjhi, there appears to be nothing against the petitioner. No doubt, petitioner carries criminal antecedent of several cases but in the present case, except confessional statement, there is nothing against him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Lakhisarai in connection with Kajra P.S. Case No. 33 of 2014.
