JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2015 Petitioner is languishing in custody since 14.03.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. It is alleged that on the confessional statement of this petitioner the house of Shahbaj @ Babul was raided from which the arms were recovered.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner though petitioner is accused in two other cases. It is further submitted that co-accused Md. Reyees and Sarwar @ Sarwer Alam were granted bail vide Cr. Misc. Nos. 31298 of 2014 and 31946 of 2014.

Considering the fact that there is no recovery from the petitioner and investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of

Patna High Court Cr.Misc. No.14031 of 2015 (2) dt.27-04-2015 2/2 the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 58 of 2014.
