The petitioner is apprehending arrest in a case registered for the offences punishable under section 7 of the E.C. Act. The prosecution case as per the written report of Saurabh Kumar, Block Supply Officer, Mashrak, is to the effect that on 1.9.2017 in the night he received information that the rice of PDS shop is being transported through a pick-up van. The informant conducted raid and intercepted the pick-up van carrying 42 bags of rice. The informant, thereafter, went to the PDS shop of the petitioner and found him absent. The other family members suggested that the papers with regard to the PDS dealership lies with the petitioner. Some of the consumers complained that the petitioner used to supply less quantity of grains.

No.60359 of 2017(2) dt.13-12-2017 2/2 It is submitted by learned counsel for the petitioner that the raid was conducted after midnight at 3 A.M. and thereafter the informant claims to have visited in the night which is not the working hour, hence the stock could not be verified and without finding any irregularity in the stock, the present case has been lodged.

Considering the fact that now the PDS licence of the petitioner has been suspended coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Saran at Chapra in connection with Mashrak P.S. Case No. 237 of 2017. (Dinesh Kumar Singh, J) anil/- U
