2. The petitioner seeks bail in connection with Madhepur P.S. Case No. 56 of 2026, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, which has been lodged on the basis of the written report submitted by the informant to the effect that on 27.02.2026, during patrolling near PHC Madhepur, the police noticed two suspicious persons. One, Vimal Kumar, was apprehended while the other, Deepak Kumar, escaped. Based on Vimal Kumar's disclosure, 3.75 litres of foreign liquor and one mobile phone were recovered from his house. Acting on this information, the police searched the shop, apprehended Rajnish Kumar, and recovered 979.560 litres of foreign liquor, which was seized in the presence of witnesses.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. The petitioner is in custody since 09.06.2026 and recovery of 979.560 liters foreign liquor has been recovered from the Kirana shop of co-accused Jiwachh Sah. The petitioner was not arrested from the place of occurrence and the name of the petitioner surfaced in this case on the basis of the confessional statement of the co-accused Vimal Kumar. He further submits that nothing has been recovered from the conscious possession of the petitioner. Therefore, the petitioner who is of clean antecedent, deserves the privilege of regular bail.
5. Learned APP for the State vehemently opposes the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
