09-11-2017 Heard Sri Dhananjay Nath Tiwari, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Motihari Muffasil P.S. Case No. 256 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner has been made accused only on the basis of confessional statement of co-accused, which was made before the police itself and save & except confessional statement, there is no other material to connect the petitioner in the present case and petitioner is having clean antecedent, which fact has been

Considering the fact that petitioner has been made accused on the basis of confessional statement of the co-accused made before the police as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Sanjeet Kumar @ Sanjit @ Ranjit @ Ranjit Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Muffasil P.S. Case No. 256 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
