JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 08.10.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

One country made loaded pistol, three live cartridges and some cash are said to have been recovered from conscious possession of the petitioner. Petitioner carries criminal antecedent of several cases.

No doubt, petitioner is in jail custody since 3.9.2014 and up till now, charge could not be framed against the petitioner but taking note of criminal antecedent of the petitioner, I am not inclined to release the petitioner on bail, at least, at this stage and accordingly, his prayer for bail in connection with Jamo Bazar P.S. Case no. 85/2014 pending in the court of Chief Judicial Magistrate, Siwan/concerned court stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible,

Patna High Court Cr.Misc. No.21867 of 2015 (4) dt.08-10-2015 preferably, within six months from the date of receipt/production of a copy of this order even by taking trial of the petitioner on day to day basis.

However, it is made clear that if trial of the petitioner is not concluded within the above stated period of six months, trial court shall be at liberty to grant privilege of bail to the petitioner, if prayer is made on behalf of the petitioner.
