JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-12-2022 Heard Mr. Jay Ram Prasad, learned counsel for the petitioner and Mr. Uday Pratap Singh, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Phulwari Sharif P.S. Case No. 479 of 2022 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code 1860.

As per the First Information Report, the Police intercepted the petitioner and arrested him along with stolen Motorcycle and one Master key.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of secret information allegedly received by the Police. He next

Patna High Court CR. MISC. No.48436 of 2022(2) dt.16-12-2022 2/2 submits that the petitioner is in custody since 10.5.2022 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the nature of allegation and the fact that the charge sheet has already been submitted and the petitioner is in custody since 10.5.2022, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIX, Patna, in connection with Phulwari Sharif P.S. Case No. 479 of 2022 subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
