JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-08-2024 Heard the learned counsel for the petitioner and learned APP for the State, assisted by the learned counsel for the informant.

2. This is an application for anticipatory bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 324, 307, 447, 448, 504 and 506/34 of the Indian Penal Code, registered in connection with Mahua P.S.Case No. 88 of 2024.

3. As per allegation, four accused persons, including the petitioner, equipped with arms and weapons, arrived at the place of occurrence where the brother of the informant was supervising the construction of boundary wall. The petitioner and co-accused Tuntun Kumar assaulted the victim with lathi fracturing his head. The victim collapsed and became unconscious.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.53105 of 2024(2) dt.02-08-2024 2/2 that there is specific allegation against co-accused Babban Kumar and Tuntun Kumar to assault Rajeev Lochan, causing him injury. So far as the petitioner is concerned, there is no allegation whatsoever against him. He is person of clean antecedents.

5. On the other hand, the learned counsel for the informant has opposed the prayer for anticipatory bail.

6. Considering the above facts and circumstances, let the petitioner, above-named, in the event of his arrest/surrender within four weeks from today, be released him on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Mahua P.S.Case No. 88 of 2024 subject to the conditions as laid down under Section 438(2) Cr. P.C.
