2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 238(b), 80(2), 3(5) of the Bhartiya Nyay Sanhita, 2023 and 4 of the D.P. Act.
3. The case of the prosecution is that the daughter of the informant Sasha Kumari (deceased) was married to one Anshu Kumar. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand. On 11.05.2025, the informant came to know from the neighbourers that the inlaws have put fire to the deceased and have taken her to Navlok
Patna High Court CR. MISC. No.46146 of 2025(3) dt.16-09-2025 2/3 Hospital, Begusarai. On 12.05.2025, when the informant went to matrimonial house of the deceased, the victim was admitted in Sadar Hospital, Begusarai where she died of her burn injuries.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that petitioners are in-laws of the deceased and during investigation, Srikant Singh one of the petitioners has stated that deceased herself has put fire to her body. It has also been submitted that main thrust of allegation is against the husband of the deceased and he is already in judicial custody. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 25.05.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Refinery P.S. Case No. 48 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like
