JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 304/34 of the Indian Penal Code.

Submission on behalf of the petitioner is that even if the prosecution story assumed to be true, then also, at best, it is a case of Sections 279 and 304 A of the Indian Penal Code which are bailable in nature. It is further submitted that petitioner is in jail custody since 31.01.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.11940 of 2016 (2) dt.17-03-2016 2/2 two sureties of the like amount each to the satisfaction of Shri R. Narayan, Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 16 of 2016.
