JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was facing trial in Session trial no. 128 of 2006/64 of 2006 and Cr. Misc. no. 22595 of 2007 was filed on his behalf for grant of bail to him but some important facts were suppressed by the person, who had sworn an affidavit in support of pleadings of Cr. Misc. No.22595 of 2007 and, after that, at the direction of a co-ordinate Bench of this court, the present case was lodged against the petitioner and other accused. Submission on behalf of the petitioner is that at the time of filing of the above stated Cr. Misc. no. 22595 of 2007, petitioner was in jail custody in connection with Mohania P.S.Case No.64 of 2006 and he was not aware of this fact that some facts have been suppressed at the time of filing of the bail

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S.Case No. 381 of 2015.
