KUMAR ORAL ORDER 30-03-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. Petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 354, 504 of the Indian Penal Code.

Informant has alleged in his written complaint that his son Md. Razzak with her daughter-in-law Mahalka Praveen had gone to his matrimonial house and on 06.10.2020 they came back and at about 10:30 P.M., accused-petitioner along with his parents and sister came and it is alleged that petitioner stabbed in the stomach of his daughter-in-law and also on chest. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case due to land dispute between the parties. Only one injury has been

Patna High Court CR. MISC. No.57556 of 2021(2) dt.30-03-2022 2/2 found on the person of daughter-in-law of informant. It is further submitted that the FIR was instituted on 16.10.2020 after 10 days of occurrence. He has no criminal antecedent and is in custody since 28.10.2020.

Learned Counsel for the informant has vehemently opposed the prayer for grant of regular bail to the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with S.T. No. 137 of 2021 arising out of Forbesganj (Simraha) P.S. Case No.876/20 with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) Rajiv/veenaU T
