The petitioner seeks bail in connection with Chandradeep P.S. Case No.70 of 2014 for the offences punishable under Sections 302 and 120B read with Section 34 of the Indian Penal Code. The prosecution story, in brief, is that on 20.08.2014 at aout 15 hours, the second brother of the informant, namely, Pramod Yadav was going towards the village Aliganj to Chandradeep by motor-cycle. When he reached near brick kiln of Abbas Mian in between Sikandara and Nawada Main Pucca Road, 5-6 criminals, who were sitting on silver colour Bolerao vehicle, surrounded the aforesaid motorcycle and thereafter the informant's brother tried to escape from their rescue but the motor-cycle was slipped. Thereafter the criminals started indiscriminate firing in which the informant's brother sustained bullet injuries and the criminals fled
Patna High Court Cr.Misc. No.20662 of 2015 (2) dt.11-06-2015 2/2 away towards Margrohar village. In course of fleeing away, the vehicle of the criminals stuck in the mud. It is further alleged that seven accused persons had murdered brother of the informant. It has been submitted on behalf of the petitioner that omnibus and general allegations have been made against the petitioner and other accused persons for making firing. It has further submitted that from perusal of the post mortem report it would appear that only six injuries were found upon the deceased. It has further been pointed out that other co-accused, namely, Ram Balak Yadav has been granted bail by a Bench of this Court vide Cr. Misc. No.5118 of 2015.
On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate, Ist class, Jamui, in connection with Chandradeep P.S. Case No.70 of 2014.
