2. The petitioner is in custody in a case registered for the offence punishable under Section 303(2) of the BNS, 2023.

3. As per allegation in the FIR, while the informant was went to Bhatthari from his house to purchase a cow and he parked there his motorcycle bearing registration no.BR21AD8285, Chesis No.MBCHAW17XNHM34384 and after some time, he could not trace his motorcycle and after making his best efforts to search his motorcycle and the same was stolen by some unknown persons.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.49499 of 2026(2) dt.22-07-2026 2/2 petitioner has falsely been implicated in this case merely on the basis of suspicion. He next submits that only on the basis of some similarity of the seized vehicle in Kawakol P.S.Case No.196 of 2026, the petitioner has been remanded in the present case and the same has been granted bail as appears from para-11 of the petition. Petitioner is in custody since 24.04.2026.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the light of the aforesaid submissions as made by learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Nawada/concerned Court in connection with Nardiganj P.S. Case No. 47 of 2026.
