JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Para 18 of the case diary reveals that it was coaccused, Shamim Mian who shot fire at the deceased and so far as petitioner is concerned, it is only stated that he was also present on the place of occurrence along with co-accused, Shamim Mian and after the incident he was caught by the informant and others. Moreover, co-accused, Shamim Mian has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 15.01.2015 passed in Cr. Misc. No. 34539 of 2014 whereas petitioner is in jail custody since 23.01.2014. Considering the aforesaid facts and circumstances as
