JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Ganga Bridge P.S. Case No. 53 of 2014 registered under Sections 147, 148, 149, 341, 323, 427, 504, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of Chief Judicial Magistrate, Vaishali at Hajipur. The accusation is that 19 persons named in the F.I.R. including the petitioner reached at the door of the informant armed with lathi, rod and illegal firearm and started to abuse and breaking the boundary wall. When the informant made protest then at the order of Devendra Rai, his sons namely, Sanjeet Rai,

Patna High Court Cr.Misc. No.13794 of 2016 (2) dt.25-04-2016 Praveen Kumar and Arvind Rai shot fire through country made pistol at Arvind Rai, nephew of the informant, who fell down and sustained injury. When the petitioner saw to Arvind Rai alive then he also fired at Arvind Rai, who thereafter died. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
