The petitioners seek bail in Belaganj P.S. Case No. 173 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added.
The informant named nine persons including the three petitioners Ram Pravesh Prasad, Daya Nand Prasad and Rakesh Kumar and alleged that all the accused persons assaulted his father with stick, brick and stone. The accused persons Ram Pravesh Prasad, Daya Nand Prasad, Chintu Kumar and Chitranjan Kumar assaulted the informant and his aunt, mother and sister-in-law. It is submitted that there is a counter version. During
Patna High Court Cr.Misc. No.20647 of 2015 (2) dt.18-06-2015 2/2 the course of investigation the father of the informant died. The father of the informant died due to ailment of heart. It is further submitted that Munna Kumar @ Munna Dom has already been enlarged on bail vide order passed in Cr. Misc. No. 13111 of 2015 and the case of the petitioner stands on same footing. Considering the facts aforesaid and the fact that there is omnibus and general allegation of assault against the petitioners and other accused persons and one similarly situated co-accused Munna Kumar @ Munna Dom has already been enlarged on bail, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Belaganj P.S. Case No. 173 of 2014.
