====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 326, 504, 506, 307 and 34 of the I.P.C.
Allegation against the petitioner is of causing injury at the abdomen of Abhishek Kumar by a dagger.
Submission is that the allegation is against Satendra Yadav as well as the petitioner of commission of injury at the abdomen. However, the doctor has found single laceration at the abdomen of Abhishek Kumar and other injuries were allegedly caused by other accused persons. Petitioner is in custody since last ten months. Investigation of the case is already concluded. Petitioner has got no criminal antecedent. Considering the completion of investigation, there is

No.3411 of 2021(4) dt.25-06-2021 2/2 no need for further detention of the petitioner as under trial prisoner, in absence of any material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mufassil P.S. Case No. 244 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
