ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Suppi P.S. Case No.86 of 2019 for allegedly having committed the offence under Sections 272, 273, 414,34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that it is only on the basis of some spy that the name of the petitioner has been brought in that he is one who links the persons who trade and sale illicitly.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of
Patna High Court CR. MISC. No.46964 of 2019(2) dt.29-07-2019 2/2 his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II, Sitamarhi Cum Special Judge, Excise Act, Sitamarhi, in connection with Suppi P.S. Case No.86 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
