Mr. Kunwar Ajit Singh, learned counsel appearing for the petitioner submits that this writ application has been filed with a prayer for directing the concerned authority to refund the amount of Rs. 4,00,000/- deposited by him in the light of the decree dated 08.02.2010 passed by the Ld. Sub Judge- 5th Vaishali at Hajipur as the petitioner is in the urgent need of the said amount.

3. After having heard the petitioner's counsel, this court does not find substance in the petitioner's prayer as the aforesaid amount was deposited by the petitioner in compliance

Patna High Court CWJC No.17344 of 2021(4) dt.04-09-2025 2/2 with the direction given by the court of Sub Judge- 5th Vaishali, who decreed the petitioner's suit filed for the specific performance of contract.

4. Accordingly, the instant writ petition stands disposed of with giving a direction to the court of Sub Judge- 4th Vaishali at Hajipur/concerned court to expedite the Execution Case No. 29 of 2010 filed by the petitioner in which the petitioner's aforesaid amount is lying deposited since 07.03.2010 at the earliest preferably within three months.

5. This writ petition stands disposed of.
