2. The petitioner seeks regular bail in the present case registered for the offence under Sections 341, 323, 324, 325, 354B, 307, 302, 504/32 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is alleged to have assaulted and killed the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 16.12.2023 and has clean antecedent. The petitioner is not the assailant of the deceased. The deceased was caught by Ajit Mandal @ Bhairav Mandal and Amit Mandal @ Guddu Mandal had assaulted the deceased

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul/concerned Court below in connection with Chhatapur P.S. Case No. 441 of 2023 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial.
