Versus
The State of Bihar.
.... .... Opposite Party/s =================================================== Appearance :
For the Petitioner/s : Mr. Raghunandan Kumar Singh, Adv. For the Opposite Party/s: Mr. Murlidhar (APP) =================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 03.
22.06.2016 Heard learned counsel for the Petitioner and the State.
The Petitioner seeks bail in S.Tr. No. 74 of 2014 arising out of Amas P.S. Case No. 121 of 2012 registered under Sections 395 and 397 of the Indian Penal Code pending before the Ad hoc Additional Sessions Judge-II, Gaya. It has been submitted that two co-accused who had been granted bail are absconding and, therefore, there is every likelihood of the trial of the Petitioner being held up. Considering that the only two witnesses are left to be examined and the Sr. S.P. Gaya is taking serious steps for ensuring their appearance, I am not inclined to review the earlier order refusing bail to the Petitioner. The prayer for bail is once again rejected.
The Trial Court shall take appropriate steps in this regard.
